"We started having sex and I heard a scream say 'Mom' and he was downstairs," said the former aide who's now 18. "I went and hid in her bathroom."
Janelle Batkins, 42, of Harrison Township then took her son to baseball practice and returned home to the teenager, he said.
The teen, whose name is being withheld because authorities say he's a sex crime victim, testified for two hours in a Clinton Township district court about the alleged affair from December 2006 to May 2007. At that time, Batkins was a French teacher at the school, but has since resigned.
With prosecutors adding seven more counts of third-degree criminal sexual conduct charges to the existing two she faces, Judge Sebastian Lucido bound her case over to Macomb County Circuit Court.
Batkins is being tried under a law that says someone with authority cannot have sex with a 17-year-old. If convicted, she faces a mandatory prison term.
Her lawyer, David Griem, questioned the teen's credibility and motives. At one point, he read a text message the aide allegedly sent to Batkins saying, "Pay me $5,000 and my mouth is sealed."
The teen's response: "I was being a 17-year-old boy and acting stupid."
He also claimed that Batkins was once concerned she was pregnant with his child, jealous of his girlfriend and desperate to be with him.
The teen's mother found evidence of the relationship on his computer before school officials and authorities got involved, police said.

A confident and poised 18-year-old man testified that his teacher at Roseville High School had sex with him 10 times in a half-dozen encounters, all but one in her home.
The man, whose identity is being withheld by The Macomb Daily, testified in 41B District Court in Clinton Township that he and Janelle Batkins had sex the first time Dec. 22 while her family went to a Red Wings hockey game, and the last time in May when he left her crying and upset. He said they kissed twice at school.
Judge Sebastian Lucido ordered Batkins, 42, of Harrison Township, to Macomb County Circuit Court to face nine counts of third-degree criminal sexual conduct, which carries a minimum penalty of more than one year in the state prison and a maximum of 15 years in prison.
Batkins was originally charged with two counts but assistant prosecutor Jean Femminineo asked for the additional counts following the testimony by the man, who graduated last June from Roseville High. He was the sole witness.
Batkins, a wife and mother of two boys, was a French teacher. She resigned in July or August. She is free on personal bond.
While the age of sexual consent in most cases is 16, a state law enacted a few years ago raised it to 19 for a defendant who has authority over an alleged victim, such as a teacher.
The man, dressed in a white long-sleeved dress shirt and black slacks, described the incidents matter-of-factly under Femminineo's questioning.
The Macomb Daily has a policy of not revealing the identity of the alleged victims of sex crimes.
Defense questions accuser's credibility
Batkins' defense attorney, David Griem, hinted that his client's defense is that the man is lying and edited her instant messaging by entering her system with her password to make her appear the culprit.
Griem told the judge: "This is he-said, she-said. The credibility of the witness is always an issue at trial and preliminary examination."
Batkins has admitted to electronically communicating with the student, but has not admitted to the sexual contents or the alleged sexual relations, according to the Macomb County Sheriff's Office, which investigated the case.
During Griem's cross-examination, the man said that at one point near the end of their relationship he "was feeling horrible. I was feeling it was all my fault."
Griem retorted, "It is all your fault."
Griem asked for a piece of paper that the man had referred to but was told to put away. The sheet appeared to be a bullet list providing details of each encounter. Griem asked several times if someone wrote it for him or if someone suggested he pen the document.
But the young man insisted that he prepared the information "last Thursday or Friday."
"I prepared them by myself," he said. "I was just thinking about things because my psychiatrist told me not to think about things -- get them out of my head."
The man said that he had shared text messages over the computer and his phone with three of his friends, to which Griem asked if he that made him feel "important" or a "real stud" among his friends.
"No more than I already am," he replied.
The man acknowledged that he and his mother have contacted a civil attorney in connection with the case.
It was unclear by the man's testimony when school officials first learned of the relationship. He testified that he told a male teacher, but said, "I didn't get any help there."
His mother last January got him removed as Batkins' teacher's aide but learned that he would have to take an English class if he was removed.
The man and his mother met with Deputy Superintendent Rebecca Vasil and high school principal Peter Hedemark in June after he graduated.
He described the incident to police July 20.
Relationship develops
The young man said the relationship started slowly as he and Batkins became friendly his junior year, when he was a teacher's aide for her and another instructor. They started talking by telephone in winter 2006 but maintained little contact over the summer.
He exclusively became her aide for her "prep hour" in fall 2006, he said. He turned 17 in October 2006, and their relationship elevated in late November.
"She invited me over to her house; that's when we kissed the very first time," he said.
She asked him again to her house Dec. 22 while her family was at the game so they could exchange Christmas gifts. He drove from Roseville to the area of Metropolitan Parkway and Crocker Boulevard.
"That gave us a time window so we could be together," he said. "I gave her a butterfly necklace because she likes butterflies. She gave me a blue Abercrombie shirt."
He said they kissed on an upstairs couch but moved to the basement.
"She led me to one of the couches in the basement," he said. "She started taking my clothes off. Then she took off my pants. All the clothes came off."
The man said they had sexual intercourse twice that night.
Mom's knowledge fails to stop it
They next had sex the night of the national college football game between University of Florida and Ohio State University in early January, arriving at her house during the second quarter, he said.
He said the relationship was discovered by his mother the next day, but he did not say how. Despite his mother's knowledge, he and Batkins had sex seven more times in four encounters. He said Batkins told him they "had to be careful" and devised ways to further hide their contact.
He said they had sex again in late January or early February when a friend drove him to her house after 11 p.m. He had told his mother he was spending the night at another friend's house and believed she would look for his car there.
The man believed Batkins' husband was gone and her one teenage son was sleeping in her room.
He said they had sex three times within three hours Feb. 21 in her bedroom, in the computer room and in the bedroom of her older son, who was away at college. The early-afternoon sex occurred only hours before the boy competed in a regional wrestling match at Warren Cousino High School.
Their next encounter occurred in the early morning hours of March 18 when she picked him up down the street from his friend's birthday party in Roseville. They had sex in her vehicle on "a side street a couple of blocks behind Eastland Elementary School," he said.
He said when he went to Panama City, Fla., for spring break in early April, he realized after a few days that he did not want to have contact with her by phone. He said early in the trip he had called her often and she wouldn't respond, and later in the trip she called but he didn't respond.
"I realized how much fun I could have when I didn't have her watching over me," he said.
About three weeks after he returned home she asked him to come to her house for his "prize" for finishing in fifth place in the state tournament, he said. The prize was sex, which they engaged in twice in her bedroom, he said. They were interrupted by her son's arrival home from school, according to his testimony. He said he hid in her bathroom while she drove her son to baseball practice and returned 10 minutes later.
One time during their relationship, Batkins told him she was pregnant with his child and that she would "have it."
"I was nervous, I was scared," he said.
Final encounter
During their last encounter in May, they were having sex when he received a telephone call from his girlfriend and went into the bathroom to talk, he testified. He said Batkins tried to listen and was crying, so he left.
The man admitted that at times toward the end of the relationship he had called Batkins several obscene names in voice or text messages.
"I figured if I was mean to her, she would leave me alone," he said.
In May, he communicated to her that his "mouth" would be "sealed" if she gave him $5,000. But he said he didn't believe she would pay it.
He admitted he sent a text message to the Batkins' family telephone, calling her vulgar names "so her family would find out and I would get it off my shoulders."
He said he had a reason for saving to a separate computer file about 10 percent of the AOL instant messaging.
"I thought I should do so in case this (court case) ever happened someone would believe me."
Under Griem's questioning, the man said he contacted the accused twice after the June meeting with school officials, once inadvertently when he dialed the wrong number.

bound over on criminal sexual conduct charges
For about three hours on Nov. 8, an 18-year-old male confidently told those present in Judge Sebastian Lucidos courtroom of his alleged sexual relationship with former Roseville High School French teacher Janelle Batkins.
He said the two were involved with one another during his senior year in 2006-07 where he was a student aide for Batkins, 42. The two had sex at her Harrison Township home over several months, he testified, and penetration was involved.
The teens mother found out, the Macomb County Sheriffs Department conducted an investigation and Batkins a married mother of two sons resigned from her teaching position.
Last Thursday with defense attorney David Griem by her side, Batkins was bound over for a hearing at 1:30 p.m. Nov. 19 in Macomb County Circuit Court on nine counts of criminal sexual conduct in the third degree. Lucido moved the case forward after hearing the teens testimony during a preliminary exam in 41B District Court in Clinton Township.
Batkins, originally charged with two counts of CSC in September, remains free on bond. The teens name is being withheld from the public because he was 17 during the alleged incidents and is considered a minor in the case. The CSC counts went from two to nine after the teens testimony last week. Batkins did not testify at last weeks hearing.
While the legal age of consent is 16 to have sex in Michigan, Batkins was charged with the crime because she was in a position of authority during the alleged affair, which is not in accordance with Michigan law. If convicted, she will serve prison time.
Friends at first
Under questioning from Macomb County Assistant Prosecutor Jean Femminineo, of the Sex Crime Unit, the teen said he and Batkins met when he was in the eighth-grade during a school wrestling trip to Iowa. The teen was on the same wrestling team as her son.
The pair became reacquainted during his 10th-grade year at RHS.
In the 11th grade, we started talking. We talked as friends, said the teen, adding the pair talked on the phone every day.
As a senior, the teen became Batkins aide and earned school credit. Thats when they allegedly began sleeping together.
According to the teen, he and Batkins had intercourse several times between December 2006 and April/May 2007 at her home. He also alleged they once had sex in her vehicle on a side street a few blocks away from Eastland Elementary School near 12 Mile and I-94 in Roseville in March of 2007. She had picked him up from a friends house where he was at a birthday party.
The pair allegedly kept in contact through their cell phones, text messages, and AOL accounts. The police seized the teens computer during the investigation.
In November 2006, one month after the teens 17th birthday, he alleged Batkins invited me over to her house. Thats when we kissed for the first time. He said that evening coincided with her sons first wrestling meet. The teen and Batkins drove to Yale together for the meet and then drove back to her house.
The teen alleged he and Batkins first had sex on Dec. 22, 2006. It occurred on an evening when her family was at a Detroit Red Wings game, he said. The two exchanged Christmas presents and we had sex for the first time. The teen alleged the pair had intercourse twice in the basement.
We started kissing, clothes started coming off and then we had sex, the teen alleged. We just sat around until it happened again.
The teen said he and Batkins had intercourse again in January 2007. He alleged during his visits, the sex occurred in different rooms of the house, including her bedroom, her sons room and a computer room. He also maintained during one visit the pair had intercourse a total of three times.
During one visit on a Friday after school, Batkins son came home while the pair was in her bedroom. The teen hid in an adjoining bathroom while she took her son to baseball.
My clothes were off and on the floor, the teen said. I hurried up and grabbed my underwear and my wife-beater (shirt) and put those in the bathroom.
He waited until she came home 10 minutes later. The teen said that was the last time they had sex. He testified he never used protection with Batkins and at one point she thought she might be pregnant by him and that she said she would keep the baby.
No longer a secret
Under cross-examination, the teen admitted he shared with friends intimate details of his relationship with Batkins. His mother also found out and told her son not to have contact with Batkins anymore, but the relationship continued. The teen told Griem he also stayed on in title only as her aide so he wouldnt have to take an English class.
My mom arranged it so my title would be in her class (but) I would not be in her class, the teen said.
Taking an English class was worse then a sexual relation with a teacher? Griem asked.
Under Griems questioning, the teen said he showed text messages from Batkins to his friends. He also said he had a girlfriend during his affair with Batkins, but didnt say for how long.
Telling your friends you were doing Mrs. Batkins, that made you feel important and made you feel you were a real stud, Griem accused.
Not anymore than I already am, the teen said.
The teen did admit to calling Batkins several names, including stupid b---h, when she wouldnt talk to him by phone while she was visiting Chicago.
Griem also asked the teen why his family retained an attorney. The teen said it was in case he needed help with the case. But Griem argued its because his family wants to ultimately sue Batkins and Roseville schools and hit the lottery.
Sometime toward the end of the school year, the teen and his mother met with school officials about the relationship. In July 07, police interviewed the teen and the case moved forward.
Batkins resigned from her teaching position last summer prior to her arrest. In 2006, Batkins celebrated her 15th year anniversary with RCS. Many family and friends were in court last week to support her. The teen, who said he is seeing a psychiatrist for his mental state, also had a few supporters.

Teacher, Charged With 30 Counts Of Statutory Rape
Megan Mahoney, 24, was arrested Monday for allegedly having regular sexual contact with the same 16-year-old student over a period of more than two months beginning in late October 2013, the Staten Island Advance reports.
She faces 30 counts of statutory rape in the case. The New York Post reports:
Mahoney romped with the teen on numerous occasions, that is at least two times per week during the period, court papers claim.
She also was charged with four counts of criminal sexual act because of mutual oral sex that she and the boy allegedly engaged in at least two times per month during said period.
In January, Mahoney resigned from Moore Catholic High School in Staten Island, where she taught gym and was an assistant coach for the women's basketball team.
Investigators said at some of the encounters happened on school grounds. In August, the victim told the New York Post that the illicit relationship began shortly after Mahoney allegedly approached him in the gym and offered to coach him in basketball.
We would just drive around and [do it] in the car, the boy, whose name was withheld, told the newspaper.
Richard Postiglione, the Moore's athletic director, was also investigated for allegedly failing to report sex abuse accusations against Mahoney and another female teacher at the school.
Before she was a coach, Mahoney was also a student athlete,
playing basketball for Fordham University and Wagner College.

Brianne Altice, 34, was arrested in October 2013 after one of her former students approached Utah police and told them that he had a sexual relationship with the English teacher beginning when he was 15 years old. He was able to describe tattoos on the teacher's body, and told police that they had sex at least seven times, including once in a public park.
Summer Michelle Hansen, 31, was charged in August with sex crimes involving 5 students at the California high school where she taught special education. Hansen allegedly sent sexually suggestive texts to at least one student, who claimed she had sex with him as a "prize" for doing well in a baseball game.
Diana Leigh Farnell, 28, turned herself in to North Carolina police on Sept. 12 following accusations that she'd had sex with one student at the high school where she taught English. One student told WCCB that he noticed flirting between Farnell and certain students in his English class.
Rachelle Gendron, 27, was charged with five counts of rape stemming from her alleged affair with a 14-year-old student. The former sexual education teacher allegedly sent the boy photos of herself in "various stages of undress, with breasts and genitals exposed," according to an indictment.
Kelly Ann Garcia, an English teacher in Texas, is accused of carrying on sexual relations with a 16-year-old female student. The Houston-area educator, who allegedly took the teen to a sex shop during their romance, faces charges of sex assault of a child and indecency with a child.
Kahtanna Culp is accused of having sex multiple times with a student at Northbrook High School in Houston. She allegedly told the school's principal about the relationship after the student threatened to make their relationship public unless she paid him.
Carrie McCandless is taken into custody after her sentencing hearing at Larimer County Justice Center for an inappropriate sexual relationship with a student at Brighton Charter High School, where she was a teacher, Friday, June 8, 2007, in Fort Collins, Colorado. McCandless was sentenced to 45 days in jail, five years on probation and a four-year deferred sentence. McCandless was arrested in May of 2011 for a parole violation after she tested positive for morphine. She served a 60-day sentence for the violation.

Erin Thorne, 28, is accused of sending one of her students sexually explicit text messages before he turned 18. The relationship turned sexual after the student turned 18, cops said.
Katheryn L. Carmean, who worked as a teacher's aid at Seaford Middle School in Delaware is accused of having sex with a 14-year-old boy at least '40 times' over a ten month period. She was arrested in February, 2012.
Elyse Cromwell, a 27-year-old New Jersey teacher, is accused of having sex with a 14-year-old student multiple times. She was reportedly the male student's English and homeroom teacher.
Leah Shipman was arrested in 2009 for having an alleged sexual affair with a 15-year-old student in North Carolina. But prosecutors were forced to drop the case in 2011 when Shipman and the then-17-year-old got married. Under North Carolina law, a husband cannot be forced to testify against his wife.
Kristine Ngum, who taught exceptional students at Myers Park High School in Charlotte, is accused of having sex with a student. Her husband denied the charges, but said Ngum is "too overcaring."
Stephanie Fletcher is accused of having sex with two 16-year-old students, including during class breaks.
Amanda Sotelo, a 35-year-old married woman, was a substitute teacher who had a months-long affair with a 14-year-old boy, police in Texas said. She learned she was pregnant, allegedly with his child, during a visit to the emergency room in September 2012. Police charged her with indecency with a child, but she claims that she and the boy are in love.
Lynne Freeman from Weld County Sheriff's Office, is a 38-year-old mother and parent volunteer at University Schools, was arrested Wednesday for the alleged sexual assault of a 14-year-old teenage boy -- a friend of her daughter's -- in her home.
Stefanie Dickinson, a Colorado school board member, was charged with Internet luring of a child in September after she was caught sexting a 14-year-old boy. The boy reportedly told police he became uncomfortable after she would show up at his football games and tell him how sexy his smile was. She was arrested in October for sexual assault on another minor, also a student.
Irene Khan was accused of having sex with a 14-year-old student on multiple occasions including in her car and home and at various hotels.
Lauren Redfern, a Colorado high school physical education teacher and basketball coach, was charged with sexual assault on a child by a person of a position of trust with a pattern of sexual abuse after suspicions arose that she was having an inappropriate sexual relationship with a 17-year-old student over the course of 4 months. Though initial interviews with the victim indicate that their relationship was consensual, it will not deter the Sheriff's Office from pressing charges against Redfern.
Andrea Ebert, a 30-year-old special education teacher at Rice Lake Middle School in Wisconsin, was jailed in February 2012 after she allegedly had sex with two 17-year-old students. None of several encounters between her and the students were reported to be on campus.
Jennifer Schultz a North Dakota school teacher, is charged with sexually assaulting two of her students after a group of students arrived at her home and asked if she would like to drink vodka with them. Authorities say that after a few drinks, two of the boys went up to Schultz's room, where the teacher allegedly had sex with one boy while the other watched.
Kelly K. Miller, 32, a science teacher in the Chicago suburbs, was charged with sexual exploitation of a child on Sept. 27 after allegedly sending explicit photos of herself to a 15-year-old student.

Turner, now 34, a former teacher who served time in jail for having sex with a 13-year-old boy, is currently serving a prison sentence for sending inappropriate photos and videos of herself to that same boy after she served out her original sentence. The Tennessee Supreme Court said that it will not hear the appeal. 7/1/23 - Update

Tara Driscoll, 33, from Garden City, N.Y., a New York City English teacher, 33, pleaded guilty to having sex with a student who attended the high school where she worked. She was sentenced to six years probation.
Rachel L. Holt, a science teacher at Claymont Elementary School, was arrested early Tuesday, April 4, 2006. The sixth-grade science teacher was accused of having sex with a 13-year-old student and was sentenced to 10 years in prison Friday March 16, 2007. Prosecutors had wanted Scott to sentence Holt to the maximum of 25 years.

Angela Comer: Kentucky grand jury indicts ex-teacher who fled
with teen
A grand jury in Kentucky on Wednesday indicted a former teacher
on charges of illegal sex acts with a minor over allegations that she
had a sexual relationship with a 14-year-old boy who had been her
student.
Angela Comer, 26, was charged with felony custodial interference, two counts of third-degree sodomy and four counts of unlawful transaction with a minor relating to sexual acts, a prosecutor handling the case said.
The interference and sodomy charges carry a punishment of one to five years in prison, and the unlawful transaction counts are punishable by up to 20 years, said the prosecutor, Monroe County (Ky.) Attorney Wes Stephens.
Comer's attorney, Johnny Bell of Glasgow, Ky., could not be reached for comment.
Comer, the teen and Comer's 4-year-old son were found in Nuevo Laredo, Mexico, on Jan. 10 after the trio disappeared from Tompkinsville, Ky., a few days earlier.
Stephens said investigators interviewed the teen Tuesday regarding incidents occurring only in Kentucky, and they learned that the first alleged sexual act occurred Oct. 25.
A romantic relationship had developed some time late last summer, Tompkinsville police said. Comer was a teacher for 1 1/2 years at Monroe County Middle School, where the teen is a student, and she taught eighth-grade math, school officials have said.
Officials in Kentucky said the pair fled to Texas, and then Mexico, to try to get married. Mexican officials took into custody Comer, the teen and Comer's son and turned them over to U.S. authorities in Laredo. The trio were returned last week to Kentucky.
The teen told authorities that Comer, using her laptop, helped former students with homework while the trio was in Mexico, Stephens said. The FBI in Texas confiscated the laptop.
